ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR SERVICES, EVEN IF GREEN LANTERN PIZZA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO GREEN LANTERN PIZZA IN THE SIX (6) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
The limitations of damages set forth above are fundamental elements of the basis of the bargain between Green Lantern Pizza and you. Some states do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law.

16. Dispute Resolution
16.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or our Services ("Dispute") informally by contacting us at [email protected]. We will attempt to resolve the Dispute informally by contacting you within thirty (30) days of receiving your notice. If the Dispute cannot be resolved informally within sixty (60) days of the initial notice, either party may proceed to formal dispute resolution as set forth below.
16.2 Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
If informal resolution is unsuccessful, any Dispute shall be finally resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in English and the arbitrator's award shall be final and binding. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
Exception: Either party may seek emergency equitable relief before a court of competent jurisdiction in order to maintain the status quo pending arbitration, or may bring claims in small claims court for Disputes within the applicable court's jurisdictional limits.
16.3 Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND GREEN LANTERN PIZZA EACH WAIVE ANY RIGHT TO A JURY TRIAL.
16.4 Time Limitation on Claims
Any Dispute must be brought within one (1) year after the cause of action arose. If a Dispute is not brought within this time period, it shall be permanently barred. This one-year limitation applies regardless of any statute or law to the contrary; however, it shall not apply where prohibited by applicable law.
17. Term and Termination
These Terms are effective as of the date first indicated above and shall remain in full force and effect until terminated. We reserve the right, in our sole discretion, to:

In such events, we will make reasonable efforts to notify affected customers and resume normal operations as soon as reasonably practicable.
22. Assignment
You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms without our prior written consent. Any purported assignment in violation of this section shall be null and void. We may assign our rights and obligations under these Terms without restriction and without notice to you, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets. These Terms shall inure to the benefit of and be binding upon each party's permitted successors and assigns.
